Pretrial Diversion is designed to keep the matter out of the courtroom. Instead of entering a plea to the charge or going to trial on the matter, you sign a contract with the prosecutor’s office placing certain conditions and requirements upon person charged. Upon satisfaction of these, prosecutor will then dismiss your case and likely be eligible for expungement.
The benefits of pretrial diversion should not be taken lightly. Because not only are you able to get the charges dropped, but you are also able to get the arrest record expunged.
Where you are innocent of the charges and you go to trial and win, then, of course, you would not have any conditions of punishment. Although acquitted, you would still have the record of arrest and that record can potentially stay on your record forever.
Diversion is a great deal whether you are truly innocent or if you really did make a mistake and commit the offense for which your are being charged.
